Alternative Dispute Resolution in the Arts, Culture and Heritage Sectors

NetGain Partners is excited to add Alternative Dispute Resolution (“ADR”) as a service to our clients. ADR is a means for disagreeing parties to come to an agreement without resorting to litigation. This allows the parties to have greater control over the costs of a dispute resolution process and the confidentiality of the subject matter in dispute. The two most common alternative dispute resolution processes are mediation and arbitration.

Examples of subject matters in dispute within the Arts, Culture and Heritage Sectors include:

  • access and benefit sharing
  • authenticity of the arts or documents
  • collection of fees, commissions, or royalties
  • contents of digital or print media
  • digitization of print media
  • intellectual property rights
  • representations of artists
  • use of art as collateral in financing transactions

Mr. Yen is a graduate of the Faculty of Law, University of Toronto and the London School of Economics, University of London. Prior to entering law school, Mr. Yen earned a Bachelor of Science degree in psychology from the University of Toronto and a Master of Business of Administration degree from the Schulich School of Business, York University. Mr. Yen takes an integrated legal and practical approach in resolving complex legal and business problems. Where practical, Mr. Yen takes steps to focus on the common interests and needs of parties to transactions or to disputes with a view to facilitate a relationship sufficient to reach cost-effective, efficient and enduring resolutions. Mr. Yen has over 28 years experience in civil litigation and transaction in areas of law that include corporate, commercial and business law, franchise law, arts and entertainment law, estate, succession and tax planning law, intellectual property law, property, and projects involving commercial business, governments, and voluntary organisations. Mr. Yen is a registered trade mark agent, a member of The Advocates Society, a founding member of the Toronto Commercial Arbitration Society and a member of the Society of Estate and Tax Practitioner. Mr. Yen is fluent in English and the Cantonese dialect.
