NetGain Partners is excited to add Alternative Dispute Resolution (“ADR”) as a service to our clients. ADR is a means for disagreeing parties to come to an agreement without resorting to litigation. This allows the parties to have greater control over the costs of a dispute resolution process and the confidentiality of the subject matter in dispute. The two most common alternative dispute resolution processes are mediation and arbitration.
Examples of subject matters in dispute within the Arts, Culture and Heritage Sectors include:
- access and benefit sharing
- authenticity of the arts or documents
- collection of fees, commissions, or royalties
- contents of digital or print media
- digitization of print media
- intellectual property rights
- representations of artists
- use of art as collateral in financing transactions
NetGain Partners’ mediator and arbitrator is Jonathan Yen of the firm Mediation Arbitration Chambers Inc (www.medarbchambers.com ).
